Acceptance of Terms

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

Service Description

Hiyori is a life-recording application combining diary with AI comic generation. Main features include:

• Writing and storing diaries
• Importing iOS system calendar events
• Adding related diaries to events
• AI-generated Daily Comics
• Browsing history comics
• Cloud sync for diaries and comics
• Downloading and sharing comic images

Account Registration

3.1 Account Requirements

• You must be at least 13 years old to use the Service.
• You must provide accurate and complete registration information.
• You are responsible for maintaining account security and confidentiality.

3.2 Account Responsibility

• You are responsible for all activities conducted using your account.
• If you discover unauthorized use of your account, please notify us immediately.

Usage Guidelines

When using the Service, you agree not to:

• Violate any applicable laws or regulations
• Upload diaries containing illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or other inappropriate content
• Attempt to gain unauthorized access to other users' accounts
• Interfere with or disrupt the Service's operation
• Use automated tools to mass access the Service
• Reverse engineer or decompile the Service
• Use the Service for any commercial purpose (unless authorized in writing by us)
• Circumvent any technical limitations or security measures of the Service

Intellectual Property Rights

5.1 Our Intellectual Property

• The Hiyori application, its design, trademarks, logos, and all related content are the property of us or our licensors.
• You may not copy, modify, distribute, or otherwise use these contents unless explicitly authorized.

5.2 AI Generated Content

• You have personal use rights to comic images generated using the Service.
• You may download, store, and share your generated comics with others.
• Commercial use of AI-generated comics or claiming them as your own creation is prohibited.

User Generated Content

6.1 Your Content

• You retain all rights to the diary content you write.
• By using the Service, you grant us a limited, non-exclusive license to process your content to provide the service (e.g., for AI comic generation).

6.2 Content Responsibility

• You are responsible for all content you upload or create.
• We have the right (but not the obligation) to review and remove content that violates these Terms.

Subscription and Payment

7.1 Free Version (7-Day Trial)

New users get a 7-day trial period: Days 1-3 allow 3 comics per day, Days 4-5 allow 2 comics per day, Days 6-7 allow 1 comic per day. During the trial, you can write unlimited diaries, import calendar, browse history, and sync to cloud. After the trial ends, you need to upgrade to premium to continue generating comics.

7.2 Premium Version

Premium offers more generation quota: up to 5 per day, 35 per month. More comic styles will be available in the future.

7.3 Subscription Plans (Taiwan)

• Monthly: NT$149/month
• Quarterly: NT$379/3 months (avg. NT$126/month)
• Yearly: NT$1,390/year (avg. NT$116/month)

7.4 Payment Method

• Subscription fees are collected via Apple In-App Purchase.
• Payment will be charged to your Apple ID account.

Cancellation and Refunds

8.1 Cancel Subscription

• Subscriptions can be cancelled at any time.
• To cancel: Go to iPhone Settings > Apple ID > Subscriptions > Hiyori > Cancel Subscription.
• After cancellation, you can continue using premium features until the current subscription period ends.

8.2 Refund Policy

• All subscription fees are processed through Apple.
• For refund requests, please contact Apple Support directly.
• We cannot process refunds directly.

Service Changes and Termination

9.1 Service Changes

• We reserve the right to modify, suspend, or terminate the Service at any time.
• Significant changes will be notified to users in advance.

9.2 Account Termination

• You can delete your account in App settings at any time.
• If you violate these Terms, we may suspend or terminate your account.
• After account termination, we will delete all your data within a reasonable time, unless required by law to retain it longer.

Disclaimers

10.1 Service Provision

• The Service is provided on an "as is" and "as available" basis.
• We do not guarantee the Service will be uninterrupted, error-free, or completely secure.

10.2 AI Generated Content

• AI-generated comics may not fully meet your expectations.
• We do not guarantee the accuracy or appropriateness of AI-generated content.

10.3 Data Loss

• While we strive to ensure data security, we are not responsible for data loss.
• We recommend regularly downloading your important comic images.

Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, punitive, or consequential damages.
• Our total liability shall not exceed the amount you paid to us in the past 12 months, or NT$1,000 (whichever is greater).

Terms Revision

• We may revise these Terms from time to time.
• Revised terms take effect upon posting.
• Significant changes will be notified via in-app notification or email.
• Continued use of the Service indicates your acceptance of the revised Terms.

Governing Law and Dispute Resolution

• These Terms are governed by the laws of the Republic of China (Taiwan).
• Any disputes arising from these Terms shall first be resolved through friendly negotiation.
• If negotiation fails, both parties agree to submit to the jurisdiction of the Taipei District Court as the court of first instance.

General Provisions

14.1 Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Service.

14.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.

14.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
